These Terms & Conditions ("Terms") govern your access to and use of twitchemote.com (the "Service"), operated by Twitchemote AB, Fabrikörvägen 4A, 13152 Stockholm, Sweden ("Twitchemote," "we," "us," or "our").

By using the Service, you agree to these Terms.
twitchemote.com lets you create, edit, and download emotes and related image assets ("Generated Content"). We may update or change features at any time.
User Content. You may upload prompts, text, images, and other materials ("User Content"). You must have all rights necessary to use and upload User Content and you must not infringe others' rights.
Prohibited uses. Do not use the Service to generate or share content that is illegal, infringes IP, exploits minors, discloses personal data without consent, promotes hate or unlawful violence, or otherwise violates these Terms. Do not attempt to interfere with or misuse the Service (e.g., scraping, reverse engineering, circumventing limits).
As between you and Twitchemote, you own the Generated Content you create through the Service. Subject to Section 5.3, you receive a worldwide, perpetual, transferable, sublicensable, royalty-free license to use, reproduce, modify, distribute, and commercialize your Generated Content for any lawful purpose.
Important limitations:
You retain ownership of your User Content. You grant Twitchemote a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display your User Content solely to operate, maintain, and provide the Service.
You grant Twitchemote a worldwide, non-exclusive, royalty-free license to store, host, reproduce, display, and use (a) your User Content and (b) your Generated Content to operate the Service, improve quality and safety, and for marketing (including showcasing examples on twitchemote.com, social channels, and product materials).
Where legally required, we will honor opt-out requests described in our Privacy Policy.
We use trusted infrastructure and partners to provide the Service (e.g., hosting, storage, analytics, and payments). Your use of integrated third-party services (such as payment checkout) may be subject to their terms.
The Service, including our brand, website, templates, and technology, is owned by Twitchemote or its licensors and is protected by applicable laws. Except for the rights expressly granted in these Terms, no licenses are implied.
If you believe content on the Service infringes your rights, send a detailed notice to contact@twitchemote.com including: (a) identification of the work or rights claimed; (b) specific URLs or asset IDs; (c) your contact details; and (d) a statement of good-faith belief and accuracy. We may remove content or suspend accounts in response to credible notices.
We may review, block, or remove content and suspend or terminate access if we believe these Terms are violated, to protect users or the Service, or to comply with law.
We strive to keep the Service available but do not guarantee uninterrupted operation. We may change or discontinue features at any time. If we make material changes to these Terms, we will post the new version and update the effective date. Continued use after changes means you accept the updated Terms.
The Service and all content are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties (express, implied, or statutory), including fitness for a particular purpose, non-infringement, and accuracy. You are responsible for your use of the Service and for ensuring your Generated Content complies with applicable law and third-party platform rules (e.g., Twitch asset guidelines).
To the maximum extent permitted by law, Twitchemote and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to these Terms or the Service, even if advised of the possibility. Our total liability for any claim is limited to the amount you paid to Twitchemote for the Service in the 12 months before the event giving rise to the claim (or EUR 50 if you used the free Service only). Consumer rights that cannot legally be limited remain unaffected.
You agree to defend, indemnify, and hold harmless Twitchemote from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your Generated Content, or your use of the Service in violation of these Terms or applicable law.
These Terms are governed by the laws of Sweden, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the courts of Sweden, with Stockholm as the chosen venue, unless mandatory law gives you the right to bring actions elsewhere (e.g., your country of residence within the EEA).
Nothing in these Terms overrides your mandatory consumer rights under applicable law. If there is a conflict between these Terms and mandatory law, mandatory law prevails.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.
If any part of these Terms is unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Twitchemote regarding the Service.
